JEFF HARDY UPDATE By Mike Johnson on 2009-11-05 07:50:25Jeff Hardy's probable cause hearing yesterday was continued to Wednesday 12/2. The hearing, spurred by Hardy's arrest this past September on a number of drug charges, will determine if (a) a crime has been committed and (b) if the defendant (Jeff) probably committed it.
The Fayetteville Observer reported that Hardy was not present at yesterday's hearing. His attorney, Jeff Van Camp told the Observer that Hardy originally intended to attend the hearing but did not as drug test results from a lab had not returned. It would appear the hearing was pushed back to accommodate those results.
If the determination is made that Jeff probably did commit the crimes he was arrested for, the case would then be passed on to a Grand Jury. The Grand Jury would review the evidence and make a decision regarding whether or not to criminally indict Hardy on the following charges:
*Felony possession of cocaine.
*Felony drug trafficking of opium
*Felony possession with intent to redistribute a Schedule III drug (two counts).
*Maintaining a dwelling for drug use and/or distribution.
*Possession of drug paraphernalia. (misdemeanor)
Should Hardy end up indicted, he would then be transferred to Superior Court to be tried, unless he opts to make a plea bargain somewhere along in the process.
